A now-20-year-old man who admitted having sex late last year with a then-12-year-old Solana Beach middle school student in the school parking lot was sentenced Monday to what amounts to probation.
The sentence is part of a deal that Calica agreed to when he pleaded guilty in October to one count of committing a lewd and lascivious act with a child under the age of 14.
Technically, Calica was sentenced to three years in state prison, but the custody time will not be imposed unless he violates the terms of his agreement — which includes staying away from social media sites where minors are predominate users.
For Monday’s sentencing, the victim’s mother wrote a letter to the court, in which she said the defendant’s actions have “turned our lives upside down and caused a happy little girl’s life to be ripped out from under her feet and put into a tailspin of depression, isolation and bitterness.”
She also railed against his sentence: “Giving Jeff probation is not punishment. It’s like giving a child a time out with no severe consequences.”
